Orders placed on ShapesPlastics.com are subject to the terms and conditions below.
Order Changes and Cancellation
Orders placed on ShapesPlastics.com are considered complete, with no guarantee that ShapesPlastics will be able to cancel or modify once placed. If an order needs to be canceled or changed, contact us immediately using our toll-free number, email, or online chat. Orders cut/fabricated or shipped are subject to our Returns & Exchanges terms and conditions.
Returns and Exchanges
Cut-to-size products are not eligible for refunds or returns. If your product arrived damaged or not cut to the size you requested (subject to a 1/8th inch tolerance), please email us within three (3) business days for options. For non-customized products (sold in our pre-defined dimension), simply contact us within 30 days after you placed the order for a refund on unused, resalable material. Non-customized product returns are subject to a restocking fee and must be returned pre-paid with our return approval number included.
Shipping & Delivery
We aim to process and ship cut-to-size orders received by 11 am EST in three-five business days. Orders requiring fabrication (polishing, corners, drill holes) require an additional two days. If your order is received during the weekend or on a holiday, we will review it on the following business day. We do not offer to ship to Alaska, Hawaii, or Puerto Rico. We are unable to deliver to APO/FPO addresses or P.O. Boxes. If you receive an order confirmation after providing any of these shipping address types, a full refund will be issued to you. Estimated transit times for ground-couriered parcels are 3-5 business days. These transit times are subject to change based on inclement weather or order complexity. Residential addresses can receive weekend delivery at no extra charge. Larger parcels might require an extra day or two delivery time. For larger packages shipped by LTL carriers, your order will be delivered to your front door or garage. Drivers will not enter your premise, perform setup or remove any packaging.
Pricing & Payment
Pricing is subject to change without notice. ShapesPlastics reserves the right to update and/or correct pricing on our website anytime. All prices are listed in U.S. Dollars (USD$). ShapesPlastics accepts most major credit cards for payment, including Visa, MasterCard, and American Express.
Sales Tax
ShapesPlastics.com is required by law to collect sales tax on domestic U.S. orders based on the ship-to address of an order. Sales taxes will be added to your order total. Shipping charges may also be subject to tax in certain states. Canadian customers are subject to a fixed $39.99 delivery cost and subject to customs brokerage and GST upon order arrival.
Shipping Cost
We offer free ground shipping for all standard (small package courier) delivery to the Lower 48 States. Canadian customers are subject to a fixed $39.99 delivery cost and subject to customs brokerage and GST upon order arrival. Larger packages require special handling and are delivered by one of our contracted LTL carriers and may incur added cost for delivery. Delivery fees, if any, will be noted at checkout. For expedited shipping, please contact us before you place an order. Expedited shipping is available on most items for an additional charge.
Third-party disclosure
We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information.
Backorders
In the event of a backorder, ShapesPlastics will contact the customer to provide available options. If ShapesPlastics is unable to contact the customer, the order will be canceled and refunded.
Events Beyond Our Control
ShapesPlastics will not be responsible if events beyond our control occur which make it impossible or commercially unreasonable for us to perform, including so-called "Acts of God" or "force majeure" events, vendor delays, and raw material shortages.
Electronic Commerce
Buyer may not share any password, access code or similar credential which may be issued to it by ShapesPlastics, and ShapesPlastics reserves the right to suspend or revoke any such credential. Buyer is solely responsible for ensuring the security and integrity of its ordering process. Any information provided by ShapesPlastics via any Internet site or electronic communication (i) is subject to correction or change without notice, and (ii) is provided for the sole use of Buyer for purposes of facilitating individual transactions involving the purchase and sale of ShapesPlastics' products. Buyer agrees that it shall not rely upon any such information for any purpose other than making individual purchases and will not seek to assert such information against ShapesPlastics for any other purpose. ShapesPlastics may issue electronic invoices for any purchases of products made using the Internet, e-mail or any other computer-based electronic communications method, and agrees to honor such invoice as if it had been delivered in writing.
Warranties & Claims
ShapesPlastics warrants that all Products sold are new and, upon payment in full by Buyer of the Products, free and clear of any security interests or liens. Services performed will be in accordance with generally acceptable industry standards. Cut-to-size (custom) parts will meet the physical dimensions agreed upon in writing. Pre-cut Products are cut to nominal sizes. If any Products fail to conform to the warranty specified in the preceding two sentences, ShapesPlastics may, at ShapesPlastics' option, either replace the Products or refund the purchase price. This is Buyer's exclusive remedy and ShapesPlastics' sole liability for breach of warranty. Buyer should not return Products until ShapesPlastics agrees that Buyer may do so. ShapesPlastics is a distributor and not a manufacturer and makes no independent warranties other than those set forth herein. ShapesPlastics shall assign to Buyer any vendor/manufacturer warranties and/or remedies provided to ShapesPlastics by its vendor, to the extent permitted by ShapesPlastics' vendors/manufacturers. BUYER UNDERSTANDS THAT CUSTOMIZATION SERVICES PERFORMED BY SHAPESPLASTICS MAY VOID VENDOR/MANUFACTURER WARRANTIES.
Intellectual Property Infringement
Any suggestions ShapesPlastics makes about possible articles, designs or uses of products do not give Buyer a license under any patent covering such articles, designs or uses, nor are they a recommendation for use of such products, articles or designs which may infringe any patent. SHAPESPLASTICS DISCLAIMS ANY AND ALL WARRANTIES AND/OR INDEMNIFICATIONS AGAINST INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHTS OF ANY NATURE. SHAPESPLASTICS SHALL, IF GIVEN PROMPT NOTICE BY BUYER OF ANY CLAIM OF INTELLECTUAL PROPERTY INFRINGEMENT WITH RESPECT TO ANY PRODUCTS SOLD HEREUNDER, REQUEST THE MANUFACTURER TO GRANT FOR THE BUYER SUCH WARRANTY OR INDEMNITY RIGHTS AS THE MANUFACTURER MAY CUSTOMARILY GIVE WITH RESPECT TO SUCH PRODUCTS.
Limitations
SHAPESPLASTICS DISCLAIMS ANY LIABILITY FOR CLAIMS ARISING OUT OF PRODUCT MISUSE, IMPROPER PRODUCT SELECTION, IMPROPER INSTALLATION, OR PRODUCT MODIFICATION, MISREPAIR OR MISAPPLICATION. THERE ARE NO OTHER WARRANTIES WRITTEN OR ORAL, EXPRESS, IMPLIED OR BY STATUTE. NO IMPLIED STATUTORY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE APPLIES. NO OTHER COSTS ARE ASSUMED BY SHAPESPLASTICS UNLESS AGREED TO, IN ADVANCE, IN WRITING.
Claims
Claims for any nonconforming Products must be made by Buyer, in writing, within thirty (30) days of Buyer's order placement of such Products and must state with particularity all material facts concerning the claim then known to Buyer. Failure by Buyer to give notice within such thirty (30) day period shall constitute an unqualified acceptance of such Products by Buyer, and a waiver of any right to reject or revoke acceptance of such Products.
Limitation of Claims
ShapesPlastics will not be responsible for any harm arising out of Buyer's purchase, possession or use of any products supplied by ShapesPlastics or any technical advice ShapesPlastics may offer, except as agreed in the Limited Warranty set out above. UNLESS APPLICABLE LAW OTHERWISE REQUIRES, SHAPESPLASTICS' TOTAL LIABILITY TO BUYER OR TO ANY OTHER PERSON, RELATING TO ANY PURCHASES GOVERNED BY THESE Ts&Cs, FROM THE USE OF THE PRODUCTS FURNISHED OR FROM ANY ADVICE, INFORMATION OR ASSISTANCE PROVIDED BY SHAPESPLASTICS (BY ANY METHOD, INCLUDING A WEB SITE), IS LIMITED TO THE PRICE OF THE PRODUCTS GIVING RISE TO THE CLAIM. SHAPESPLASTICS WILL NOT BE LIABLE FOR CONSEQUENTIAL, SPECIAL, INCIDENTAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, COST OF ANY SUBSTITUTE FOR THE PRODUCTS BUYER BOUGHT, CLAIMS OF THIRD PARTIES OR INJURY TO PERSONS OR PROPERTY.
Custom Products
If Buyer orders cut-to-size products from ShapesPlastics or products made by ShapesPlastics or ShapesPlastics' vendor to Buyer's specifications or design ("Custom Products"), ShapesPlastics is not responsible for verifying or confirming the accuracy of specifications provided to ShapesPlastics for such Custom Products. All Custom Products are sold on a "FINAL SALE" basis only, and no cancellations, returns, refunds or credits are allowed.
Technical Advice & Other Services
Buyer is responsible for the design, processing, testing and labeling of any product that Buyer makes using Products Buyer buys from ShapesPlastics, and Buyer will not rely on anything on ShapesPlastics' web site or any statement by ShapesPlastics about the suitability of Products ShapesPlastics provides. Product cross-reference comparisons do not imply that Products are perfectly comparable. COMPARED PRODUCTS ARE NOT REPRESENTED OR WARRANTED AS FUNCTIONAL OR PERFORMANCE EQUIVALENTS. Buyer shall review all Products prior to purchase and use to determine suitability for customer's intended use. By purchasing Products, Buyer represents and warrants that it has tested and investigated Products sold by ShapesPlastics enough to form an independent judgment concerning their suitability for the use intended by Buyer and will not make any claim against ShapesPlastics based on ShapesPlastics' advice, statements, information, services or recommendations. Jurisdictions have varying laws, codes and regulations governing construction, installation, and/or use of products for a particular purpose. It is Buyer's responsibility to review all applicable laws, codes and regulations for each relevant jurisdiction to be sure that the construction, installation, and/or use involving the Products are compliant.
Jurisdiction and Exported Goods
ShapesPlastics® is a registered trademark of Polymershapes LLC. These terms and conditions are the complete contract with Polymershapes LLC and ShapesPlastics.com, and shall be governed by the substantive law of the state of New York, without giving effect to its conflicts of laws principles. They apply to products purchased for domestic consumption in the United States. If exported, purchaser assumes full responsibility for compliance with US export controls.
